Terms
Rental Items
Company agrees to rent to Renter the items described in detail in the rental items list (hereinafter, “Rental Items List”), which is incorporated by reference, made a part of this Agreement.
Rental Fees
Renter agrees to pay Beautiful Morning the fees specified in the Rental Items List, along with applicable delivery charges or other charges stated in the Rental Items List. Rental Fees are for the time the Rental Items are reserved or out and away from Company’s possession, regardless of whether the Rental Items are actually used by Renter. No refunds will be given for unused Rental Items.
Payment Schedule
All rental fees must be paid in full 30 days prior to the event date to ensure reservation of the items. A non-refundable deposit of 25% of the total rental fee is required once the rental items have been confirmed. This deposit will secure the items for your event and will be applied toward the total rental fee. Failure to pay the full balance by the due date may result in cancellation of the rental and forfeiture of the deposit.
Damaged or missing rental items Prior to start of event
If Renter discovers damaged or missing Rental Items prior to the start of the Event, Renter agrees to notify Company immediately. Company agrees to make all reasonable attempts to provide a replacement or substitute for any damaged or missing Rental Items prior to the Event
stated start time, or if no reasonable replacement or substitute item can be provided, to promptly refund the cost of the damaged or missing item to Renter. Renter agrees that any damaged Rental Items will not be used at the Event. All damaged Rental Items remain the property of Company and must be returned to Company.
Damaged or missing rental items
Renter agrees to pay for any damages beyond normal wear and tear occurring after the Rental Items are delivered to Renter, including damage occurring as a result of any person other than a Company representative moving the Rental Items from the location where they were delivered by Company; damages occurring during the Event; damages occurring following the Event, including while cleaning off the Rental Items or while packing up the Rental Items, are the sole
responsibility of Renter, whether actually caused by Renter or by Renter’s guests, Event venue staff, or third party Event vendors.
Glassware
All rented glassware must be returned to its designated container in the same condition it was received. Failure to return glassware in the proper container may result in an additional handling fee. Any missing or broken glassware will be charged at the full replacement cost.
Dinnerware (Plates & Silverware)
Customers are responsible for ensuring that all rented plates and silverware are rinsed before return. If rinsing is not possible, we will accept items that have been scraped clean of all large food particles. Additional cleaning fees may apply if items are returned with excessive food residue. Any missing or damaged dinnerware will be billed at full replacement cost.
Linen Rentals
Linens are expected to be returned in normal used condition. However, any damage beyond reasonable wear and tear—such as burns, cuts, rips, permanent stains, or other irreparable damage—will require full replacement at the customer’s expense. Replacement charges will be based on the current market value of the damaged linen.
Tent Rental Terms:
Customers are responsible for ensuring that tents are used safely and appropriately throughout the duration of their rental. Under no circumstances should there be any open flames, cooking equipment, heaters, or smoking under or near the tent, as this poses a serious fire hazard and will result in damage charges. Customers must avoid attaching anything to the tent structure, including signs, decorations, or lighting, unless approved in advance by Beautiful Morning Event Rentals. Any damage to the tent, including rips, burns, stains, or structural harm, will result in additional repair or replacement fees. Tents must be set up on level ground and in an area free of sharp objects or underground obstructions. Customers are responsible for securing any necessary permits or permissions required by their venue or municipality. In the event of severe weather, it is the customer’s responsibility to ensure safety and evacuation from the tent if needed. Beautiful Morning Event Rentals is not liable for injuries or damages resulting from misuse or failure to follow these guidelines.
Damage Waiver & Replacement Costs
All orders include a damage waiver fee that has been paid, it will be applied toward any damage costs incurred. If the total replacement or repair costs exceed the damage waiver fee, the customer will be responsible for paying the remaining balance.
Delivery Services
Renter agrees to pay a delivery fee (the “Delivery Fee”), if any, which is based upon location and those Rental Items itemized on the Rental Items List. Company agrees to deliver Rental Items door-to-door
only, unless other arrangements are confirmed in writing. If Renter adds or changes Rental Items, location, or requests revised delivery/retrieval dates/times from the original booking, Company may increase the Delivery Fee.
Term of Agreement
This Agreement will become effective on the date both parties sign the Agreement.
Warranty, Waiver, Indemnification, and Hold Harmless Agreement
No Warranties
The Renter acknowledges and agrees that Beautiful Morning, LLC ("Company") is not the manufacturer of the rented items. All rental items are provided "as is" without any warranties, express or implied. The Company makes no warranties of merchantability, suitability, fitness for a particular purpose, design, utility, capacity, or freedom from defects. The Company further disclaims any warranty against interference or infringement regarding the rental items, all of which the Renter expressly waives.
Assumption of Risk & Liability
The Renter assumes all risk, liability, and responsibility for any loss, damage, or claims arising from the rental items, including but not limited to:
Use, transportation, loading, unloading, installation, alteration, maintenance, storage, retrieval, and repossession.
Personal injuries or property damage due to severe weather, contact with utility lines, cables, concrete, asphalt, or other ground surfaces.
Risks related to uneven or slick flooring, proximity to heat sources, flammable or noxious substances, stretching, cracking, tearing, leaking, mold, mildew, or other potential hazards.
Intellectual property infringement claims related to the rental items.
Indemnification & Hold Harmless
The Renter agrees to indemnify, defend, and hold harmless Beautiful Morning, LLC, including its owners, officers, directors, shareholders, agents, employees, insurers, subcontractors, successors, and assigns, from and against any and all liabilities, claims, damages, losses, costs, and expenses, including but not limited to attorney fees, arising from or in connection with the rental items—even if such claims result from the Company’s negligence.
General Photo Release
Renter agrees that Company may use any images from the Event for Company’s portfolio, advertising, website, blog and magazine submissions and any other means of promotion. Renter waives any right to payment, royalties or any other consideration for the use of the images. Renter waives the right to inspect or approve the finished product, including written or electronic copy, wherein Renter’s likeness appears. Company is hereby held harmless and released and forever discharged from all claims, demands, and causes of action which Renter, their heirs, representatives, executors, administrators, or any other persons acting on Renter’s behalf or on behalf of the Renter’s estates have or may have by reason of this authorization.
Cancelation Policy
Renter has up to 3 weeks before the event to cancel for rain, personal, or other reasons. At this point renter will receive a refund on items purchased. Refunds do not include the nonrefundable deposit, or 25% of the total rental cost if a deposit was not paid. If renter cancels without a 3 week notice NO REFUND will be offered.
HOWEVER, Beautiful Morning Rentals will work with the renter to
reschedule and deliver items at a later date.
